Show Suggested Answer Hide Answer
Suggested Answer: C

Express terms are the terms of the agreement which are expressly agreed between the parties. Ideally, they will be written down in a contract between the parties but where the contract is agreed verbally, they will be the terms discussed and agreed between the parties.

The types of express terms to be found in a contract are many and varied and will depend on the type of contract. Any term written into the contract is an express term and may refer to price, time scales, warranties and indemnities, limitations on liability, conditions precedent and so on.

Ha! This question is so easy, it's like asking 'Which part of a sandwich is the bread?' Contract particulars and terms and conditions, duh! That's the meat and cheese, the heart of the matter. Legislation and custom and practice? That's like the condiments, the stuff that just makes it all come together.

Option C all the way, baby! Legislation and custom and practice? That's like the salad before the steak. Contract particulars and terms and conditions are the main course, the real deal. I mean, who orders a salad when they can have a juicy, delicious steak?

Hmm, this one's a toughie. But I think I'm gonna have to agree with option C. Those contract particulars and terms and conditions are the real deal, the stuff that makes a contract a contract. Legislation and custom and practice? That's like the garnish, am I right?

Yeah, I agree. Legislation and custom and practice might set the stage, but it's the contract particulars and terms and conditions that really seal the deal.

I'm gonna have to go with option C on this one. Legislation and custom and practice are more like implied terms, you know? The contract particulars and terms and conditions are the meat and potatoes of any agreement.
