I'd go with B. They're considered out of compliance if they refuse to update with the rest of the network. That's just how it works in the blockchain world.

Option A seems the most accurate to me. Those nodes are basically on a different blockchain now, so they're not in sync with the rest of the network.

I think those 20 nodes are effectually now operating on a different blockchain network than the nodes that updated.
